TERMS AND CONDITIONS


By booking a trip with us you are deemed to have agreed to these Booking Conditions and your booking will be accepted by us on this basis. The services to be provided will be mentioned in your booking confirmation vouchers.

1.Booking advance requirement

You are required to pay an advance of 50% of your bookingamount, at the time of booking and the balance amount before the commencement of your trip. If this balance is not paid before the due date, we reserve the right to treat your booking as cancelled with terms of our cancellation policy (See 3D).

2.Payment details

All prices on our website are in Thai Baht (THB).
We offer the following payment methods:

  •  A. Bank transfer to our Thai account.
  •              We will send account details by email
  •  B. By cash or credit card
  •                You will have to come to our office to swipe your card or to give cash
3.Cancellation by the traveler

If you cancel some or all portions of your booking cancellation fees will apply. A cancellation will only be effective when we receive written confirmation of the cancellation. If you cancel a trip:

  •  A. After confirmed bookings, you will incur a penalty of 10% of the total tour cost.
  •  B. Within 16 to 30 days prior of the tour date, you will incur a penalty of 25% of the total tour cost.
  •  C. Within 8 to 15 days prior of the tour date, you will incur a penalty of 50% of the total tour cost.
  •  D. Within 2 to 7 days prior of the tour date, you will incur a penalty of 75% of the total tour cost.
  •  E. Unused tours or cancellation wit in last 24 hours are non-refundable.

  •     **Cancellation policy will not be applicable if you have booked nonrefundable hotels or flights; in such a case, no refund will be given.

 If you leave a trip for any reason after it has commenced we are not obliged to make any refunds for unused services. If you fail to join a tour, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation fees are in addition to fees which may be levied by accommodation providers, travel agents or third party tour and transport operator fees.

4. Cancellation by us

We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. If we cancel your trip, you can transfer amounts paid to an alternate departure date with any changes in price for that period or receive a full refund. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, and travel insurance excess or non-refundable flights.

5. Passport and visas

You must carry a valid passport and have obtained all of the appropriate visas, permits and certificates for Thailand during your trip. Your passport must be valid for 6 months beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct visas, permits and certificates for your trip. We are not responsible if you are refused entry into the country because you lack the correct passport, visa or other travel documentation.

6. Flexibility

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

7. Prices & surcharges

Our trip prices are subject to variable and seasonal pricing, both of which are standard practice within the travel industry. This means our trip prices may vary at any time in accordance with demand, market conditions and availability. It is likely that different passengers on the same trip have been charged different prices. Your best option if you like the price you see is to book at that time. Any reduced pricing or discounts that may become available after you have booked will not apply.

8. Your details

In order for us to confirm your travel arrangements you must provide all requested details. Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements.

9. Limitation of liability

We contract with a network of companies, government agencies and individuals to assist in the running of our trips as agent for these third parties. We are not responsible for the acts and omissions of these third parties. We are also not responsible for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a trip.

10. Changes to these Terms and Conditions

Magic Holidays has the authority and the right to at any time it sees fit to change or modify all or any part of these terms and conditions.

Terms and Conditions for Flight Bookings

1. Magic Holidays Bangkok co Ltd will use its best endeavors to ensure that all flight prices are correct at the time that they are quoted. However, air fares and taxes can only be guaranteed when flight bookings have been paid in full and tickets have been issued. Flight bookings cannot be transferred.

2. Airfares are subject to prices and conditions quoted by airlines and cannot be guaranteed by us. Certain fees may be payable in respect of transactions provided by us, as notified at the time of the relevant reservation. These fees may include cancellation fees and, where amendment is permitted, amendment fees. In some cases, we may impose cancellation and/or amendment fees in addition to those imposed by travel service providers. Before entering into a transaction, you should carefully check to see whether any other cancellation or amendment fees apply.

3. Any cancellation or amendment request must be sent to us in writing, by email, and also by a phone call. Please ensure that you have received written confirmation of any changes to your booking prior to travel. Whilst we will try to assist, we cannot guarantee that such requests will be met. Amendments and cancellations can only be accepted in accordance with the booking conditions of the airlines.

4. Airlines reserve the right to change their prices without notice. We are not responsible for the same.

5. Payment must be made, in full, for all tickets issued regardless of whether they are used or submitted for refund. Refunds will be considered only before flight departure date or till the validity of the ticket.

6. We shall not be responsible for refused boarding by airline or entry to any country .The traveler should ensure that he/she has complied with the necessary health, passport, visa, re-entry permits, or other legal requirements.

7. In the case of flight reservations, full payment is required at the time of ticketing unless prior credit facilities have been approved by us.

8. Airlines reserve the right to cancel unticketed reservations or duplicate bookings in cases where passengers are holding multiple reservations through other agents.

9. We will advise you of ticketing time limits which may apply and cannot be held responsible for cancelled seats for any reservation which has not been ticketed.

10. Applications for refunds on unused airline tickets must be submitted to us with the original, unused airline ticket which is required by the relevant airline for assessment. Should a refund be authorized by the airline, such refund will be made to the person who paid for the original ticket, less any cancellation or administration charges. Only tickets issued by our office will be processed by us.

11. Our responsibility is for your booking and its booking conditions. As agent, we accept no responsibility for the actual provision of the Arrangements. Our responsibilities are limited to making the booking in accordance with your instructions. We accept no responsibility for death or personal injury that arises as a result of your negligence .We will not pay you any compensation and will not be held responsible, if we have to cancel, change or amend your travel arrangements in any way due to unusual or unforeseeable circumstances beyond our control. These can include, but are not limited to, war, threat of war, civil unrest, industrial dispute (including Air Traffic control disputes), terrorism and its consequences, natural disaster, nuclear disaster, fire, adverse weather conditions, pandemics and epidemics, unavoidable technical problems with transport, closure or congestion of airports or ports and all similar events outside our or the suppliers(s) control.
